А great software development deal worth $250 thousands was shut in Ukraine by International Commercial Arbitration Court in March 2009. The Court reached the decision that Ukrainian developers are engaged to return all the payment to customer – advance $125 thousands, for legal costs $7 thousands - $132 thousands in total.
The agreement was opened between Everfield Capital UK – owner of online hotel reservation websites, and the Miratech UK - one of the software development leaders with Ukrainian back office as a general contractor. In November, 2007 Miratech has signed the engagement to develop software for online travel agency (like Expedia, Orbitz, Opodo) - first to market in Ukraine and CIS countries. In the beginning of 2008 after several months of disputes on the functional biases and non-observance of contract terms, dissatisfied customer has shut the deal in court.
Today top-managers of Miratech still do not consider the fulfillment of the court`s decision a must. Such insubordination will be prequalified the deal into the criminal. The material losses will be covered by means of judicial performers.
Representative Everfield Capital UK, Ivan Kovpak hopes that having announced to methods of operation inside the deal with the one of leaders of IT services in Ukraine - the assets acquired by international corporation Telenor and EDB Business Partner in use since 2008, - he can indicate problem of reputation for all Ukrainian IT-market. According to Ivan, Miratech shareholders could call for submissions their Ukrainian asset and settle the conflict formed because of non-observance of the international commercial low.
Not long ago Ukraine entered the top software developer countries aspiring to raise up its ranks of entrusted IT outsourcers of the world. The costumers inside the country are not the widest segment of consumers of their software products. That`s why developers often work as back offices of the international corporations applying European level of management, ISO 9001:2000, certifying their specialists at Cisco, IBM, Microsoft, Oracle, Sun etc. Now Miratech occupies 30 % of the Ukrainian software market. The customer who had to break off the contract with market leader also looses his confidence in Ukrainian IT.
All ex-USSR countries divide world IT-outsourcing orders partially. On Russia drops out near 40 % of all software incomes, further follow Ukraine and Poland. Thus the allocation of IT orders makes our common sense to have stable international ratios. Considering that from the beginning of the year IT segment in Ukraine has fallen to 40-50% whether it`s good to place orders into the Ukrainian IT companies if the leader has such a non-observant image?
